New Soc. Sec. Number “No Match Rule”….dead for now

Posted in: Immigration Law

A federal judge had issued a preliminary injunction preventing the Department of Homeland Security (DHS) from enforcing its newly promulgated regulation concerning how employers must respond when put on notice by the Social Security Administration (SSA) that the names and/or social security numbers of its employees do not match SSA’s database. DHS planned the new rule as the centerpiece of its new drive to enforce the existing legal prohibitions on the employment of unauthorized aliens.  As most people reading this will probably know, employers are required to have all new employees complete an I-9 form and show certain documents which demonstrate eligibility to be employed in the United States.
